I don’t see how the GNA act applies to COVID testing.
It solely covers genetic tests, defined as a test that analyzes DNA, RNA or chromosomes for purposes such as the prediction of disease or vertical transmission risks, or monitoring, diagnosis or prognosis.
Sure a COVID swab has DNA on it, but that is not what is being analyzed. Looking at the opinions of actual lawyers, they don’t see it as being contrary to the statute. Obviously employer-employee matters are not governed by the Charter or Constitution.
